| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated January 23, 2009, in the above-entitled matter, which, inter alia, denied a motion by the appellant to stay all proceedings in the above-entitled action, on an appeal from an order of the Supreme Court, Westchester County, entered December 2, 2008, is amended by deleting from the first paragraph thereof the words "Application by the respondent to dismiss the motion", and substituting therefor the words "Application by the appellant to dismiss the cross motion", and by deleting from the fourth decretal paragraph thereof the word "bench" and substituting therefor the word "branch".
