DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent, Barry D. Pincus, for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 14, 1980, under the name Barry David Pincus. By opinion and order of this court dated April 1, 1996, he was disbarred, effective immediately, upon the acceptance of his resignation.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied.

We find that the respondent does not demonstrate the requisite fitness and character to practice law.
