SCHEDULING ORDER

Appeal by Mitchell Singer from an order of the Supreme Court, Nassau County, dated October 10, 2008. Pursuant to § 670.4(a)(2) of the rules of this court (see 22 NYCRR 670.4[a][2]), it is

ORDERED that the appellant's time to perfect the appeal is enlarged until February 25, 2009, and the record or appendix on the appeal and the appellant's brief shall be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted.
