It is Ordered that the motion to vacate the stay is granted. The warrant of eviction may be executed after February 10, 2009. This is to afford the appellant a final opportunity to avoid eviction by depositing the October 2008 through February 2009 use and occupancy, totaling $6,232.75, with the Clerk of the Civil Court, and thereafter moving for a continuation of the stay beyond February 10, 2009.
