DECISION Motion by tenant-appellant for stay pending hearing and determination of the appeal granted on condition that within 10 days of the date of this decision and order tenant-appellant pay landlord any and all arrears in rent and/or use and occupancy for December 2008 and January 2009 at the rate previously payable as rent and continue to pay landlord rent and/or use and occupancy as the same becomes due and perfect the appeal by March 6, 2009.
In the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or the landlord-respondent may move to vacate the stay on three days' notice.
