DECISION & ORDER ON MOTION

Motion by the respondents-appellants, on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated August 20, 2007, to enlarge the time to serve and file a brief. Application by the respondents pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, and upon the application, it is

ORDERED that the motion is granted, and the respondents-appellants shall serve and file their answering brief, including their points of argument on the cross appeal, on or before February 17, 2009 (see 22 NYCRR 670.8[c][3]); and it is further,

ORDERED that the application is granted to the extent that the respondents' brief shall be served and filed in accordance with the rules of the court (see 22 NYCRR 670.8[c][3]).
