DECISION & ORDER ON MOTION

Motion by the respondent to modify a decision and order on motion of this court dated October 31, 2008, which, inter alia, stayed enforcement of certain provisions of an order of the Family Court, Suffolk County, dated October 17, 2008, pending hearing and determination of an appeal from the order, and to direct the appellant to enter an inpatient sex offender program.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.

We note that outpatient treatment should continue at the current facility or at an alternative facility, if directed by the Family Court, Suffolk County.
