On the court's own motion, it is
ORDERED that its decision and order on motion dated February 3, 2009, in the above-entitled matter, which granted a motion by the respondent, on an appeal from a judgment of the County Court, Westchester County, rendered October 27, 2008, is amended by deleting from the first paragraph the words "a judgment of the Supreme Court, Queens County, rendered November 19, 1996," and substituting therefor the words "a judgment of the County Court, Westchester County, rendered October 27, 2008,".
