| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to appeal to this cou rt from an order of the Family Court, Kings County, dated January 15, 2009, to stay all proceedings in the above-entitled action, as well as enforcement of the order, pending hearing and determination of the appeal, for poor person relief, and the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied.
