| DECISION & ORDER ON MOTION |
Motion by the petitioner-respondent to dismiss an appeal from an order of the Family Court, Queens County, dated March 11, 2008, on the ground that the appellant failed to provide a complete transcript of the proceedings. Cross motion by the appellant to deem the "record on appeal sufficient" or to enlarge the time to provide the missing transcripts. By decision and order on motion dated November 19, 2008, inter alia, the motion to dismiss the appeal was denied on the condition that the appellant file the missing transcripts with the clerk of the court on or before January 20, 2009. The missing transcripts have not been filed. Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements.
