DECISION & ORDER ON MOTION

Motion by the petitioner pro se in a proceeding pursuant to CPLR article 78, which was transferred to this court by an order of the Supreme Court, Richmond County, dated February 13, 2008, to waive the certification requirements of 22 NYCRR 670.10.2(f).

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the court's own motion, the record submitted by the petitioner is deemed to be an appendix; and it is further,

ORDERED that the motion to waive the certification requirements of 22 NYCRR 670.10.2(f) regarding that appendix is granted.
