ORDER TO SHOW CAUSE

Proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Suffolk County, dated May 17, 2006. The proceeding was never perfected.

Now, on the court's own motion, it is

ORDERED that the parties or their attorneys show cause before this court why an order should or should not be made and entered dismissing the above-entitled proceeding for failure to timely perfect (see 22 NYCRR 670.8[e]), by filing affirmations on that issue with the Clerk of this court on or before March 6, 2009; and it is further,

ORDERED that the Clerk of this court, or his designee, shall serve a copy of this order to show cause on the parties or their attorneys by regular mail.
