An appeal having been taken herein from an order of the Family Court, Steuben County, entered in the Office of the Clerk of said Court on July 14, 2008, and the law guardian having moved for an extension of time within which to file and serve his brief,
Now, upon reading and filing the affidavit of Steven P. Maio, Esq., sworn to February 17, 2009, the notice of motion with proof of service thereof, the statement of Mary P. Davison, Esq., dated February 18, 2009, and due deliberation having been had thereon,
