On the court's own motion, it is
ORDERED that its decision and order on motion dated March 3, 2009, in the above-entitled action, which transferred an appeal from a judgment of the Fourth District Court of the Supreme Court, Suffolk County, entered December 16, 2008, to the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts, is amended by deleting from the decretal paragraph thereof the words "Nassau County", and substituting therefor the words "Suffolk County".
