| DECISION & ORDER ON MOTION |
Motion by the respondent on appeals from a decision of the Surrogate's Court, Queens County, dated May 2, 2008, to dismiss the appeal of Harvey Feinrider on the ground that no appeal lies from a decision.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the appeal of Harvey Feinrider is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co.,100 AD2d 509); and it is further,
ORDERED that on the court's own motion, the appeal of Judith Feinrider is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co.,100 AD2d 509).
