Motion by the attorney for the child to dismiss an appeal from an order of the Family Court, Queens County, dated May 16, 2008, "on the ground that there is no triable issue of fact or law upon which [the court can] reverse or modify."

ORDERED that the motion is denied without prejudice to the attorney for the child raising the issue in the brief.
