Defendant having moved to consolidate the appeals and cross appeal taken from a judgment and an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on March 26, 2008 and April 28, 2008, and for an extension of time to perfect the appeals,
Now, upon reading and filing the affirmation of Roger T. Davison dated February 24, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be, and the same hereby is, granted, the appeals and cross appeal from the judgment and the order entered March 26, 2008 and April 28, 2008 are hereby consolidated for the purposes of perfecting and arguing the appeals and cross appeal, the first ordering paragraph of the order of this Court entered January 5, 2009 is hereby amended by deleting the date March 6, 2009 and inserting in its place the date April 24, 2009, and the second ordering paragraph of said order is hereby amended by deleting the date April 6, 2009 and inserting in its place the date May 29, 2009.
