DECISION On the court's own motion, motions by appellant returnable on January 30, 2009, are consolidated for the purposes of disposition.
That branch of the motion seeking to have retained counsel relieved of representing appellant on the appeal is granted, and matter is struck from the general calendar.
That branch of the motion seeking assignment of counsel is denied.
That branch of the motion seeking an enlargement of time to perfect the appeal is granted, and appeal shall be perfected on or before June 5, 2009.
Respondent shall serve and file a respondent's brief or statement adopting the heretofore submitted respondent's brief within 15 days of the date of filing of the appellant's brief. Appellant, if so advised, may cause a reply brief to be served and may file same within 15 days of the date of filing of the new respondent's brief or statement.
