On the court's own motion, it is
ORDERED that its decision and order on motion dated February 11, 2009, in the above-entitled matter, which dismissed an appeal from decision of the Supreme Court, Nassau County, dated December 3, 2008, is amended by deleting from the preamble thereof the words "Suffolk County", and substituting therefor the words "Nassau County".
