Motion by the appellants to amend a decision and order of this court dated December 23, 2008, which determined an appeal from a judgment of the Supreme Court, Rockland County, dated April 6, 2007. Separate motion by the respondents for leave to reargue the appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court.
