DECISION & ORDER ON MOTION

On the court's own motion, it is

ORDERED that its decision and order on motion dated March 17, 2009, in the above-entitled matter, which granted in part and denied in part a motion by the appellant, on an appeal from two orders of the Supreme Court, Queens County, entered December 10, 2008, and February 5, 2009, respectively, is amended by deleting from the last paragraph the words "the branches of the motion which are to waive payment of the filing fee, to be provided with transcripts free of charge, and for the assignment of counsel are denied", and substituting therefor the words "the branch of the motion which is to waive payment of the filing fee is denied".
