It is Ordered that the motion is granted to the extent of directing the Commissioner of Finance of the City of New York to release the funds on deposit, plus interest and less any costs, to the movant-appellant herein - Edward J. Ziek. The motion insofar as it seeks a stay of the execution of the warrant of eviction is denied.
