| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Suffolk County, dated May 17, 2006. By order to show cause dated February 23, 2009, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the above-entitled proceeding for failure to timely perfect (see 22 NYCRR 670.8[e]).
Now, on the court's own motion, and the papers filed in response to the order to show cause, it is
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that the petitioners' time to perfect the proceeding is enlarged until May 14, 2009, and the petitioners' record or appendix and brief must be served and filed on or before that date.
