Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Niagara County Court, rendered December 11, 2008, and for other relief,

Now, upon reading and filing the affidavit of Anthony G. Workman, Sr., sworn to March 3, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted to the extent that Michael McNelis is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before April 24, 2009, and

It is further ORDERED that the motion is otherwise denied with leave to renew upon proof of filing and service of the notice of appeal.
