DECISION AND ORDER
ON MOTION


Motion for poor person relief, extension of time to perfect appeals, for stay and/or vacatur pending appeal and other relief.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED, that the application for permission to proceed as a poor person is granted. The appeal may be perfected in accordance with section 800.13 of the Rules of Practice (22 NYCRR 800.13). Mitch Kessler, Esq., 63 Pike Creek Drive, Cohoes, New York 12047, assigned to represent appellant upon this appeal pursuant to Family Court Act §1120. The Clerk of the Family Court of Rensselaer County is directed to furnish to appellant's counsel one copy of the transcripts of the stenographic minutes of all proceedings in the matter, except those portions which appellant's counsel or the Family Court determines are unnecessary for perfection of the appeal, and to forward the other copy to the Clerk of this Court pursuant to section 800.4(c) of the Rules of Practice, and it is further

ORDERED that the motion for an extension of time to perfect the appeals is granted, without costs, only to the extent that the time to perfect the appeal taken by notice to appeal dated April 8, 2008 is extended to June 1, 2009, and the motion is, in all other respects, denied, and it is further

ORDERED that the motion for a stay and/or vacatur pending the appeal is denied, without costs.
