ORDERED that its decision and order on motion dated April 3, 2009, in the above-entitled case, which sua sponte dismissed an appeal by Paris Miller from an order of the Supreme Court, Nassau County, dated March 10, 2009, is amended by deleting from the caption thereof Appellate Division Docket No. "009-02749", and substituting therefor Appellate Division Docket No. "2009-02749".
