| DECISION & ORDER ON MOTION |
Motion by respondents Fleetridge Owners, Inc., and Gramatan Management, Inc., joined by respondent Skiros Corp., on an appeal from an order of the Supreme Court, Westchester County, entered January 31, 2008, inter alia, to strike stated portions of the appellants' brief, and to enlarge the time to serve and file their briefs.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike stated portions of the appellants' brief is granted to the extent that the appellants' brief is stricken, and the appellants shall serve and file a replacement brief on or before April 29, 2009, that does not contain the issue raised in Point I of the stricken brief; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file the respondents' briefs is denied as unnecessary; and it is further,
ORDERED that the motion is otherwise denied.
