| DECISION & ORDER ON MOTION |
Motion by the Esther Weitzner for leave to appeal to this court from an order of the Supreme Court, Kings County, dated March 17, 2009, to stay enforcement of certain ex parte orders pending hearing and determination of the appeal, to "set [a] date for [a] traverse hearing," for poor person relief, and for the assignment of counsel. Application by Yisroel Weitzner for costs on the motion.
Upon the papers filed in support of the motion and the papers filed in opposition thereto and upon the application, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the branches of the motion which are to stay enforcement of certain ex parte orders, to "set [a] date for [a] traverse hearing," for poor person relief, and for the assignment of counsel are denied as academic; and it is further,
ORDERED that the application is denied.
