Respondent having moved for reargument and reconsideration of the order of this Court entered February 6, 2009,
Now, upon reading and filing the affirmation of William G. Zickl, dated February 26, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the appeal shall be added to the day calendar for May 19, 2009 at 9:30 a.m., and
It is further ORDERED that the appellant may file and serve a brief on or before April 22, 2009 addressing whether County Court erred in delegating its responsibility to conduct the restitution hearing to its court attorney, and
It is further ORDERED that the respondent may file and serve a brief on or before May 7, 2009.
