It is Ordered that the motion for a stay is granted on condition that the appellant: 1- on or before April 22, 2009 deposits $2,400.51 , representing four month's use and occupancy due, with the Clerk of the Civil Court; 2- continues to tender accruing use and occupancy, at $480.11 per month, to the petitioner, without prejudice; and 3- perfects the appeal by no later than June 15, 2009, for the next available term. In the event of appellant's failure to comply with the foregoing conditions, the petitioner may move on five days' notice for an order vacating the stay.
