ORDERED that the order on application of this court dated April 7, 2009, in the above-entitled matter, which granted an application by the appellant to withdraw an appeal from an order of the County Court, Nassau County, dated October 16, 2007, is amended by deleting from the second paragraph the words "no papers having been filed in opposition or in relation thereto," and substituting therefor the words "the papers filed in relation thereto."
