It is hereby ORDERED that the motion be and the same hereby is granted to the extent that the order of this Court dated February 12, 2009 is hereby amended by striking therefrom the date February 27, 2009 and inserting in place thereof the date April 24, 2009 (see People v Sher, 35 NY2d 310).
