| DECISION & ORDER ON MOTION |
Appeal by Susan Sciametta from an order of the Supreme Court, Suffolk County, dated February 13, 2008. By decision and order on motion dated January 22, 2009, the appellant was directed to advise the court, on or before February 23, 2009, whether she had retained new counsel or whether she would proceed pro se, and her time to perfect the appeal was enlarged until March 23, 2009. The appellant has not complied with the decision and order on motion dated January 22, 2009, and has not perfected the appeal.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements.
