DECISION & ORDER ON MOTION

Motion by counsel assigned to represent the defendant Armondo Reyes in the County Court, Orange County, to be relieved of the assignment to respond to an appeal by the People from an order of that court, dated November 18, 2008, and for the assignment of new counsel. Application by the respondent Armondo Reyes pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that counsel is directed to turn over all papers in the action to new counsel herein assigned; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel for Armondo Reyes to respond to the appeal from said order:

Richard L. Herzfeld, Esq.

555 5th Avenue, 14th Floor

New York, NY 10007

and it is further,

ORDERED that the respondent Armondo Reyes is directed to serve one copy of his brief and to file nine copies thereof; and it is further,

ORDERED that the application is granted and the respondent Armondo Reyes's time to serve and file a brief is enlarged until June 1, 2009, and the respondent Armondo Reyes's brief must be served and filed on or before that date.
