Town House Mgt., a Partnership v Belinsky, Joseph, et al.
It is Ordered that the motion is granted to the extent of continuing the stay of the execution of the warrant of eviction through June 16, 2009. If, by said date, the appeal has been perfected and the April, May and June use and occupancy has been tendered to the petitioner, then the appellant may move for a further continuation of the stay. Otherwise, the warrant may be executed after June 16, 2009. The papers submitted as a cross-motion, not have been timely served, were considered solely in opposition to the motion. (CPLR § 2215 and 2103[b][2]).
