DECISION & ORDER ON MOTION

Motion by the plaintiff for leave to appeal to this court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated September 19, 2008, which affirmed, insofar as appealed from and reviewed, an order of the Civil Court of the City of New York, Queens County, entered November 8, 2007.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
