Motion by the petitioner to stay all proceedings in an action entitled People v Zalmar Silber & Andrew Dale, pending in the County Court, Rockland County, under Indictment Number 2008-382, pending hearing and determination of a proceeding pursuant to CPLR article 78 in the nature of prohibition.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and all proceedings in an action entitled People v Zalmar Silber & Andrew Dale, pending in the County Court, Rockland County, under Indictment Number 2008-382, are stayed pending hearing and determination of the proceeding.
