ORDERED that its decision and order on motion dated April 17, 2009, in the above-entitled case on appeals by Kelly Makara and Karen Khan from an order of the Supreme Court, Dutchess County, dated December 3, 2008, and an order and judgment (one paper) of the same court dated December 12, 2008, respectively, which vacated a stay granted by decision and order on motion of this court dated January 8, 2009, is recalled and vacated, and the stay granted by decision and order on motion dated January 8, 2009, is reinstated nunc pro tunc.
