Orders of this Court having been entered June 10, 2005 and August 18, 2005, granting appellant permission to proceed as a poor person on appeal from a judgment of the Supreme Court, Erie County, rendered May 11, 2005, and assigning James a. Mullenhoff, Esq., as counsel to represent appellant, and an order having been entered December 22, 2006 affirming said judgment,
Now, upon the Court's own motion,
It is hereby ORDERED that CHARLES J. GREENBERG, ESQ., P.O. Box 102, Buffalo, New York 14207-0102, is substituted as counsel to represent appellant, in place and stead of James A. Mullenhoff, Esq., for the purpose of filing and serving an application for leave to appeal to the Court of Appeals from the order of this Court entered December 22, 2006; and
It is further ORDERED that the Clerk of Erie County is hereby directed to provide CHARLES J. GREENBERG, ESQ., with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
