| ORDER ON APPLICATION |
Application by the respondent St. Johns Associates, LLC, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Kings County, dated June 2, 2008, and for this Court to take judicial notice of certain material.
ORDERED that the branch of the application to enlarge time is granted and the time of the respondent St. Johns Associates, LLC, to serve and file a brief is enlarged until May 15, 2009, and the brief of the respondent St. Johns Associates, LLC, must be served and filed on or before that date; and it is further,
ORDERED that the branch of the application which is for this Court to take judicial notice of certain material is denied without prejudice to making a motion for same relief.
