DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Family Court, Dutchess County, dated March 27, 2009, pending hearing and determination of an appeal therefrom, and for poor person relief and the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is dismissed for failure to serve the motion papers in compliance with the order to show cause of this court dated April 20, 2009.
