DECISION & ORDER ON MOTION

Motion by the appellants to stay all proceedings in the above-entitled action pending hearing and determination of an appeal from an order of the Supreme Court, Richmond County, dated December 22, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the court's own motion, the appeal from so much of the order as denied reargument is dismissed, without costs or disbursements, on the ground that no appeal lies from an order that denies leave to reargue; and it is further,

ORDERED that the motion is denied.
