| DECISION & ORDER ON MOTION |
Motion by the respondent to enlarge the judgment roll on an appeal from a judgment of the County Court, Dutchess County, rendered April 1, 2008, to include the transcript of the proceedings on January 31, 2008. Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, and upon the application, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before May 15, 2009, the respondent shall file a copy of the transcript of the proceedings on January 31, 2008, in the office of the Clerk of this court as part of the original papers; and it is further,
ORDERED that the application is granted and the reply brief submitted to the Clerk of the court is accepted for filing.
