Application by the respondent-appellant Wallace L. Leinheardt on an appeal from an order and judgment (one paper) of the Supreme Court, Queens County, dated March 24, 2005 (Appellate Division Docket No. 2007-07602), an appeal and cross appeals from an order of the same court dated May 17, 2007 (Appellate Division Docket No. 2007-05196), and appeals from two orders of the same court dated June 21, 2007 (Appellate Division Docket No. 2007-06775), and October 9, 2007 (Appellate Division Docket No. 2007-11148), to withdraw his cross appeal from the order dated May 17, 2007 (Appellate Division Docket No. 2007-05196).
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the cross appeal by the respondent-appellant Wallace L. Leinheardt from the order dated May 17, 2007 (Appellate Division Docket No. 2007-05196), is deemed withdrawn, without costs or disbursements.
