DECISION & ORDER ON MOTION

Motion by the appellant, in effect, to deem the notice of appeal from an order of the Supreme Court, Queens County, dated June 24, 2008, to be a notice of appeal from a judgment of conviction of the same court rendered June 25, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is granted and the notice of appeal from the order dated June 24, 2008, is deemed to be a notice of appeal from the judgment of conviction rendered June 25, 2008 (see CPL 460.10[6]).
