DECISION & ORDER ON MOTION

Motion by the appellants to stay enforcement of an order of the Supreme Court, Kings County, dated April 13, 2009, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED the branch of the motion which is to stay enforcement of so much of the order as directed the appellant to pay to respondents' counsel the sum of $10,000 is denied as academic as the appellants have posted an undertaking in that amount pursuant to CPLR 5519(a)(2); and it is further,

ORDERED that the motion is otherwise denied.
