DECISION

Motion by appellant for clarification of the decision and order of this court dated January 7, 2009 is denied.

The decision and order of this court dated January 7, 2009 were not unclear. They did not address the portion of the Civil Court's order vacating a judgment that had been granted on inquest, because that portion of the Civil Court's order had not been appealed. The judgment that was granted on inquest on June 27, 2007 remains vacated, and plaintiff may not enforce that judgment.
