DECISION

That branch of the motion by appellant to vacate dismissal of the appeal is granted and appeal shall be perfected by July 2, 2009.

That branch of the motion seeking to stay sentence pending determination of the appeal is granted on condition that the appeal is perfected by July 2, 2009.
