Appellant having moved for permission to proceed as a poor person on the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Monroe on January 16, 2009, and for an extension of time to file his notice of appeal,

Now, upon reading and filing the affidavits of Richard Robles sworn to April 10, 2009, the notices of motion with proof of service thereof, the supplemental affidavit of Richard Robles sworn to May 2, 2009, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for permission to proceed as a poor person be, and the same hereby is, granted, and the motion for an extension is otherwise granted on the condition that appellant file a copy of his notice of appeal in the Monroe County Clerk's Office within 30 days of service of a copy of this order with notice of entry (see CPLR 5520 [a]).
