Motion by the appellant to enlarge time to perfect an appeal from an order of the Supreme Court, Queens County, entered June 26, 2008. Cross motion by the respondents TJH Medical Services, P.C., Medisys Management, LLC, Medisys Health Network, Inc., Jamaica Hospital Medical Center, Thomas Santucci, and Pauline Marks to dismiss the appeal on the ground that the appeal has been rendered academic.
Upon the papers filed in support of the motion and the cross motion, the papers filed in opposition to the motion, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the cross motion is granted, and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion is denied as academic.
